On October 11, 2022, Judge Christy Criswell Wiegand of the U.S. District Court for the Western District of Pennsylvania preliminarily approved a class action settlement agreement resolving disability discrimination claims in Douglass v. Optavia LLC.

The lawsuit, filed on behalf of the client by East End Trial Group of Pittsburgh, Pennsylvania, claimed that Optavia LLC failed to communicate information at its online store fully and equally to consumers who use screen readers to access digital content, thereby violating the Americans with Disabilities Act.

The settlement, the text of which is located here, seeks to resolve all claims for injunctive relief under all federal, state, and local laws. It listed BVA and its members as one of ten entities to be notified of the settlement.
